TERMS OF SALE
1. PURPOSE OF THIS DOCUMENT
These General Conditions of Sale (hereinafter “General Conditions”) govern the sale to end consumers (hereinafter “Customers”) of products made by Gran Pasticceria Barbera Società Cooperativa (hereinafter “Gran Pasticceria Barbera”) and marketed by the same through telephone contacts, email, online sales and at the point of sale in Via Luigi de Luca, 40, 98051 Barcellona Pozzo di Gotto (ME).
For the purposes of these General Conditions, the final consumer is any natural person who acts for purposes other than any entrepreneurial, commercial, artisanal or professional activity carried out. The Products are marketed by Gran Pasticceria Barbera Società Cooperativa with registered office in Via Luigi de Luca, 40, 98051 Barcellona Pozzo di Gotto (ME), VAT number 01777460831. 2. METHODS OF CONCLUSION OF THE CONTRACT
The proposal to purchase the Products is formulated by the Customer at the time of sending the pro-forma invoice. By sending the pro-forma invoice, the Customer accepts that any purchase contract will be governed by these General Conditions. The purchase contract between the Customer and Gran Pasticceria Barbera will be concluded only when the Customer's order is accepted by Gran Pasticceria Barbera and is shipped. In this case, Gran Pasticceria Barbera will send the Customer, to the email address provided by the latter, confirmation that the purchase order is being processed.

3. PRICES AND PAYMENT TERMS
The selling prices are those shown in this catalogue. The selling prices of the Products include VAT but do not include shipping costs, which will be added to the total amount due. Shipping costs will be free for orders over €150. The Customer undertakes to pay the price of the Products purchased with the following methods: Paypal, in this case the charge will be made upon confirmation of receipt of the order; bank transfer, shipping will only take place after receipt of payment. In the event that Gran Pasticceria Barbera does not accept the order proposal, the amount will be credited back to the Customer.
4. PRODUCT SHIPPING METHODS
Shipping costs are the responsibility of the Customer and may vary depending on the delivery service chosen.
In case of production delays, the Customer will be promptly notified by Gran Pasticceria Barbera customer service. Shipments are made only within Italy. The risks relating to the Products pass to the Customer upon delivery of the Products to the courier.
5. RIGHT OF WITHDRAWAL
As regulated by Legislative Decree no. 21/2014 “Implementation of Directive no. 83/2011 on the protection of consumers in respect of distance contracts”, the right of withdrawal does not apply to perishable goods.
6. PRODUCTS
The Customer undertakes to verify the integrity of the packaging and the conformity of the product in front of the store manager in case of collection at the point of sale, or in front of the Courier in case of home delivery. In the event that the packaging is visibly damaged, the Customer undertakes not to receive it, leaving it in the store or returning it to the Courier and activating in both cases the refund/replacement procedure.
